PROMOTION DESCRIPTION. The Path 2 Vermont Giveaway (the “Sweepstakes”) is a Daily Sweepstakes that begins on 12/28/11 at 12:00:00 AM (ET) and ends on 2/7/12 at 11:59:59 PM (ET) (“Promotion Period”). There will be one (1) Daily Prize winner in the Sweepstakes to be determined by random drawing from among all eligible entries received from all methods combined for each Day of the Promotion Period. For purposes of these Official Rules, a “Day” is defined as a consecutive twenty-four (24) period beginning at 12:00:00 AM (ET) and ending at 11:59:59 PM (ET). By participating in the Sweepstakes, each entrant agrees to comply with and abide by these official rules and the decisions of Vermont Department of Tourism and Marketing, One National Life Drive, 6th Floor, Montpelier, VT 05620 (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: Open to legal residents of the fifty (50) United States and District of Columbia who are 18 years of age or older at time of entry. Employees of Vermont Department of Tourism and Marketing, its parent company, affiliates, subsidiaries, partners, advertising and promotion agencies (collectively, “Promotion Entities”) and their immediate family members and/or those living in the same household of each are not eligible to participate. All federal, state and local laws and regulations apply. Void where prohibited.
HOW TO ENTER THE SWEEPSTAKES. There are two (2) ways to enter the Sweepstakes:
TEXT MESSAGE ENTRY: Submit a Short Message Service (“SMS”) via text message containing the keyword “Vermont” to 95495 (the “Short Code”) from your wireless phone. You may receive several text messages in response, including a message confirming your entry, legal disclaimers and options to receive future promotional messages from any of the Promotion Entities. Carrier specific charges for text messages may apply, depending on your individual wireless pricing plan, in accordance with your wireless customer agreement. You may opt-out of receiving the promotional text messages from Sponsor at any time by sending a reply text message with the words “STOP”. SMS may not be available for all service providers or for all handsets. Wireless phone carrier’s instructions for text messaging may be different. Check your phone capabilities for specific instructions. The text message entry portion of this Sweepstakes works with most U.S. wireless carriers and requires a two-way text messaging enabled wireless phone. Sponsor makes no guarantee that any particular wireless service provider will participate. Check with your service provider for details. By texting the code, the entrant grants permission to the Sponsor to notify them via a return text message and must agree to accept all applicable charges associated therewith. Wireless service providers may charge entrants for each text message, including any error message, that is sent and received in connection with the Sweepstakes, based on the applicable wireless service pricing plan. You are responsible for all applicable fees and taxes associated with placing an SMS Entry. Sponsor in its sole discretion may add or delete a wireless carrier at any time, without notice. Proof of text messaging the Short Code is not considered proof of delivery to or receipt by Sponsor of such entry. Text message entries must be completed by 11:59:59 PM (ET) on the desired Day of entry.
MAIL-IN: To enter for free, on a 3”x 5” piece of paper, hand write your full name, address, age, day/evening phone numbers and email address (if available) and send in an envelope with sufficient postage affixed to: Path 2 Vermont Giveaway, Attn: Entry, P.O. Box 34786, Omaha, NE 68134. Mail-in entries must be postmarked on the desired Day of entry. In the event that a desired Day of entry falls on a Sunday, then the entry will be entered into the Daily drawing for the Sunday and the following Monday.
Sponsor is not responsible for lost, late, misdirected, illegible, incomplete, damaged, postage due or mutilated mail and entry forms. No mechanically reproduced, altered, forged, or facsimile entries will be accepted. No automated entry devices, bots and/or other programs and/or software are permitted for Sweepstakes entry. All entries become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind, whether mechanical, human or electronic. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these official rules and the decisions of the judges, which will be final and binding in all matters relating to the Sweepstakes.
Limit one (1) Sweepstakes entry per person, per Day - regardless of method of entry (“Maximum Number”). Sponsor is not responsible for any change of mailing address and/or telephone number of entrants. In the event of a dispute, any SMS entries will be deemed to have been submitted by the Authorized Account Holder of the wireless phone used to enter (SMS entry) submitted at the time of entry, provided that person meets all eligibility requirements set forth in these Official Rules. “Authorized Account Holder” means the natural person who is assigned to a wireless phone number by a wireless service provider or other organization that is responsible for assigning cellular phone numbers associated with the submitted accounts. Entrants may not enter more than the Maximum Number of entries allowed with multiple cellular phone numbers. Any entrant who attempts to enter more than the Maximum Number using multiple cellular phone numbers or under multiple identities will be disqualified from participation in the Sweepstakes and all entries from that individual will be considered void.
RANDOM DRAWING: One (1) Daily winner will be selected in a random drawing to be conducted on or about ten (10) days after the entry Day from among all eligible entries received from all methods combined for each Day by Sponsor or its designee, the judges in this Sweepstakes, whose decisions are final and binding. Winners will be notified by phone and/or mail at Sponsor’s discretion.
PRIZES/APPROXIMATE RETAIL VALUES (ARV)/ODDS: Forty Two (42) Daily Prizes (one prize per each Day of the Promotion Period): A Pair of Ski Tickets to one (1) of sixteen (16) Vermont Ski Resorts (ARV $100 ea. winner). Tickets are subject to the terms and conditions associated with their use. Total ARV of all prizes $4,200. Travel is not included as part of the prize. Odds of winning depend on total number of eligible entries received from all methods combined each Day of the Promotion Period. Unclaimed prizes will not be awarded. All applicable federal, state, and local taxes on prize are the sole responsibility of the prize winners. Limit one (1) prize per person.
GENERAL: Potential prize winners will be required to sign and return a notarized Affidavit of Eligibility/Liability Release and, where permitted by law, Publicity Release within five (5) days after first notification attempt. If prize notification or prize is returned as non-deliverable, prize may be forfeited and an alternate winner may be selected. No correspondence will be acknowledged. No cash equivalents, substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. Subject to all federal, state and local laws/regulations. Neither Promotion Entities nor their employees will have any liability whatsoever for any injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use and/or misuse of any prize or participation in the Promotion or any prize-related activities. Acceptance of a prize shall be construed as and signify the winner’s agreement and consent that Sponsor may use the winner’s name, voice, likeness and/or prize information, without limitation, for promotional purposes without further consideration, review, approval or payment, where allowed by law. Winners acknowledge that neither Sponsor nor its agents have made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturers’ terms therefore and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding in all respects. Sponsor not responsible for any typographical or other error in the printing of the offer or in administration of the Sweepstakes.
Any attempted form of entry into the Sweepstakes, other than the entry methods stated, is prohibited. No automatic, programmed, robotic or similar means of entry are permitted. Promotion Entities are not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an entrant’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s phone, or other matter relating to or resulting from participating in this Sweepstakes or downloading any materials in the Sweepstakes. If for any reason the SMS portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the SMS portion of the Sweepstakes and select the winners by random drawing from among all eligible entries received from all methods combined up to the point of the action taken by the Sponsor. Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law.
